Mutunga strikes again,shows Kibaki the middle finger

The High Court has overturned the appointment of 47 County Commissioners.

It ruled that President Kibaki had no powers to name the County bosses and deploy them to their respective Counties.

The President also flouted the Constitution as his list did not reflect gender balance as provided for in the supreme law.

The court ruled that the State failed to give any convincing reason why it ignored the gender rule when the appointments were made.

At least that's the only part of the state machinery that is working. It was funny for Saitoti and Kimemia quoting the old constituition as the basis of these illegal appointments.

Court says its unconstituitional and that's it. Kibaki should have consulted first before making decisions on his own.
This is what happens when one has only home boys surrounding you and no one can raise any critical voice because they all think its good for "nyumba!.
Guys will have to be recalled ASAP.

Kibaki took the oath to obey the laws and the consitution of this country and therefore he has no choice but to do what the court says. This is why most military coups are immediately followed with the suspension of the constitution and the judges. It is a sign that laws are about to be broken in a very serious way. This constitution and this court led by Mutunga is going to be the engine of change.

I think Punda means impunity. Like Kibaki ignoring the court. Hehehe...our friend is living in a time warp. How will Kibaki pay his commissioners? Split his own salary perhaps?

Rubbish. The problem with placing quasi-literate folks on the bench. Where is the constitution does it state that 1/3 of all the appointments must be from one gender? I'm going to UG.

Good decision by the court. Just because kibaki stole the elections does not mean heshould not follow the law. With court decision these people have to be deployed or terminated. They cannot collect check as county commissioner neither can they issue orders. IF they do otherwise someone can go back to court and have them charged.
