Vooke,
For IEBC to LEGALLY remove Raila name from list of candidates, he must follow certain procedures. As far as i know he wrote a letter to the IEBC. That is not sufficient for IEBC to remove his name from the list.

Therefore we may end up with the situation where Raila says he has withdrawn but his name is on the ballot.

What NASA team did was to rely on Raila 2013 decision on abandoning the race, but the judgement did not give procedures for abandoning. Therefore we then rely on legislation and regulations to determine the procedures of withdrawal. And Raila does not satisfy those procedures.

This man is a Kigeugeu and he always shifts poles whenever he feels like it suits him.

Before Aug 08 elections he promised his supporters he wont go to them and say elections were stolen after Aug 08 elections he negated on that promise and went to his supporters and told them its no him coming to them to say them elections were stolen but its the courts. Funny enough his supporters forgave him.

If decides to negate on what he said (fact is that as at now he is still in the race )in the presser he will concort a story and sell it to his supporters and still his supporters will buy in to the story.

Bottom line is Raila is not able to beat UhuRuto , he doesnt have the numbers he doesnt have the message he doesnt have muscle. Thats the bitter truth to his supporters and the swret truth to UhuRuto supporters

What I’m saying is, in the eyes of the whole world Baba is out of the race regardless of whether his name is there or not.

The procedure of withdrawing is 3 days after nomination. Seeing we are well past three days, my understanding is the regulations are already overtaken by events

The Commission cannot compel a candidate to participate in an election. The law allows a candidate to withdraw his/her candidature by delivering to the Commission a duly filled Form 24A. This Form is provided for by the Elections (General) Regulations.

We note that the Rt. Honorable Raila Odinga and his running mate sent a letter dated 10th October 2017 indicating that they had decided to withdraw from the fresh Presidential Election. They however have not submitted the statutory Form 24A. Once the Commission receives the requisite Notice from any of the candidates, it will process the same in accordance with the requisite provision of the Law.

Form over substance. IEBC will include his name on the ballot.

It's a trap to set grounds for petition by claiming the candidate was removed from the ballot without formally withdrawing

what makes it more fake is that the primary purpose of his withdrawal is to force IEBC to call ANOTHER election in 60 days, presumably where he will also participate. His main intention is to make Uhuru's presidency illegitimate after November 1 which in reality is a civilian coup. Another thing he would be hard put to justify withdrawing from an election and assuming he can participate in the by-election caused by his withdrawal in the first place

Kunadawa , Precisely.....The constituion only recognizes the following elections .The elections to held on second Tuesday of August every five years ànd incase of a nullification etc a repeat election within 60 days. The constituion is silent on an election which might happen after 60 days in essence saying any elections which will be done outside the constituional dispensation will be illigetimate. Meaning Uhuru is supposed to serve as an incumbent up untill August 2022 which ofcourse is not tenable nor practical hence they will use this as a basis to call mediation and force a Nusu mkate government which they are now calling a caretaker government.


Thats what they are looking for nothing like a fresh election in 90 days. If lets say God forbid and IEBC agrees to their call of new elections with new nominations in 90 days they will now come out clear and say its unconstituional and they way out of this crisis is a caretaker government.

Kenyans and the whole world have seen this and Kenya will have an election on 26th October.
